The heart of the issue lies in the potential loss of independence for the National Institute for Health and Care Excellence (Nice), the body responsible for determining drug prices and treatments for the NHS.
Campaign groups, including Global Justice Now and Just Treatment, have threatened legal action, arguing that allowing the health secretary to override Nice's decisions is an "unlawful power grab." They believe this move could lead to even higher drug prices for the NHS, putting patients' lives at risk.
"This is a dangerous game the government is playing," says Nick Dearden, director of Global Justice Now. "By removing the checks and balances provided by Nice, they are essentially handing over control to big pharma, and that could have devastating consequences for NHS patients."
The deal, struck with the Trump administration, has been shrouded in secrecy, with MPs from various parties expressing concern over the lack of transparency and the government's refusal to release impact assessments. Diarmaid McDonald, director of Just Treatment, highlights the government's reluctance to engage in proper scrutiny, stating, "They've used a process that makes it almost impossible for MPs to understand and challenge their actions."
However, the government maintains that the deal will benefit patients by providing access to innovative medicines and ensuring tariff-free drug exports to the US. A DHSC spokesperson emphasized, "Nice's independence will be protected."
But the campaigners and MPs are not convinced. They argue that the government's actions go against the Health and Social Care Act 2012 and that the potential loss of Nice's independence could have far-reaching implications.
"If Nice's independence is compromised, it sets a dangerous precedent," says Andrew Lansley, a former Conservative health secretary. "It undermines the very foundation of our healthcare system and could lead to a situation where patients are at the mercy of drug companies' pricing strategies."
